This Privacy Policy explains how KEA AUSTRALIA PTY LTD trading as Kea Australia (ABN 64 639 547 363) ("we", "us", "our") collects, uses, shares and protects your personal information when you visit our website, buy from us, subscribe to our emails or contact us (the "Services").
We sell to customers in Australia and New Zealand. We handle personal information in line with the Australian Privacy Principles under the Privacy Act 1988 (Cth) and the Information Privacy Principles under the New Zealand Privacy Act 2020.
If there is a conflict between our Terms of Service and this Privacy Policy about personal information, this Privacy Policy applies.
"Personal information" means information that identifies you or could reasonably be used to identify you. We only collect information that we need to run our store and provide our Services. Depending on how you use the Services, we may collect:
• Contact details: your name, email address, phone number, billing address and delivery address.
• Order information: the products you buy, return or exchange, order history, and delivery details.

You do not have to give us your personal information, but if you don't, we may not be able to process your order or respond to your request. You can browse our website without creating an account.
• Directly from you, when you place an order, create an account, subscribe to our emails, post a review or contact us.
• Automatically, through cookies and similar technologies when you use our website.
• From our service providers, such as Shopify, our payment providers and delivery carriers, when they process information for us (for example, delivery tracking updates).
We use your personal information to:
• process and deliver your orders, payments, returns, exchanges and refunds;
• create and manage your account;
• respond to your questions and complaints;
• send you service messages about your orders and account;
• send you marketing emails if you have subscribed (see below);

We do not sell your personal information. We share it only where needed to run our business, including with:
• Shopify, which hosts our online store and processes order, account and website data;
• payment providers, to process your payments and refunds;

• email and marketing providers [CHECK: e.g. Shopify Email, Klaviyo], to send emails you have subscribed to;

Some of our service providers store or process personal information outside Australia and New Zealand. This includes Shopify and other providers that may store information in countries such as Canada, the United States, Ireland and other countries where they or their sub-processors operate. If a privacy breach is likely to cause serious harm to you, we will notify you and the relevant regulator as required by law: the Office of the Australian Information Commissioner (Australia) or the Office of the Privacy Commissioner (New Zealand).
We keep personal information only for as long as we need it for the purposes in this policy, or as required by law. For example:

Our Services are not directed at children. You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. If you are a parent or guardian and believe your child has given us personal information without your consent, please contact us and we will delete it.
You can ask us to:
• access the personal information we hold about you;
• correct personal information that is inaccurate, out of date or incomplete;
• delete your personal information, unless we need to keep it for legal reasons, such as tax records; and
• stop sending you marketing emails, by using the unsubscribe link or contacting us.

If we refuse your request, we will tell you why in writing and how you can make a complaint. If we refuse to correct your information, you can ask us to attach a statement to your information saying that you believe it is wrong.
